This Privacy Policy applies to “GoEars” (the “Application”). The Application is a mobile application dedicated to wireless headphones from E-USE, and it allows you to customize the sound from your headphones according to your preference.

In this Privacy Policy, we use “E-USE,” “we,” “us,” and “our” to refer to E-USE Corporation. This Privacy Policy explains our collection, use, sharing and other practices regarding your data.


  • We use the data we collect (Collected Data) to provide you with features and functions of “GoEars” Application, and to communicate with you and provide you with other requested content related to our services and other offerings. Please read 2. What information does E-USE collect? and 3. How does E-USE use the Collected Data? and here to learn more.
  • We may share or disclose the Collected Data when we engage a third party to process data on our behalf, when such sharing is required by law, or in certain other situations. Please read 4. Who else has access to the Collected Data? to learn more.
  • Depending on where you are located, the Collected Data may be transferred out of your home country/region to the United States, Japan and other jurisdictions that may not provide the same level of data protection as your home country/region. Please read 6. Transfer of the Collected Data internationally to learn more.

2. What information does E-USE collect?

E-USE collects and uses information or data as described below. Some of this information may be considered personal information under applicable law in your jurisdiction, and it is collected when you choose to provide information to us or automatically when you use the Application (collectively, the “Collected Data”).

  • (i) Information collected when you create a Account:

    If you decide to activate certain services, such as the Backup and restoration of settings service described in section 3. (ii), you will be required to create an account (“App Account”). You may create an App Account by signing in through your social networking service such as Google, Facebook, Amazon, Apple (collectively referred to as “SNS”) or by a E-USE account for GoEars Application (“E-USE account”). E-USE will assign identifiers to the App Account and may collect the following information: (i) Email address; (ii) Display name; (iii) Country/Region; and (iv) Postal code. Please note that a separate App Account will be created for each sign-in method you choose.
    Note that the information we collect from and through an SNS may depend on the privacy settings you have set with the SNS and the permissions you grant to us in connection with linking your App Account to your SNS. In general, we may collect the following information that we may receive from a SNS: (i) First and last name; (ii) Email address; (iii) Tokens as a result of sign-in authentication; and (iv) Sign-in method you chose. We do not share any Collected Data with the SNS, but the personal information an SNS has about you is obtained by the SNS independent of our App Account and the Application, and E-USE is not responsible for it.
    If you choose to create a E-USE account, E-USE will assign identifiers and collect the following personal data you input when creating the E-USE account: (i) Email address (ii) Password; (iii) Date of birth; (iv) Country/Region (v) Language preferences. Once you have successfully signed into your E-USE account, your device will receive a digital ‘access token’ from such E-USE account. Please note that if you have certain E-USE accounts for other E-USE products and services, the registered and updated information will be synchronized automatically.
    In order to provide you the Backup and restoration of settings service, we will store settings of the Related Device according to the Application (i.e. Adaptive Sound Control, Personalised Sound Setting and Automatic download of software settings) (“Related Device Settings Data”) and link this information with your respective App Account. Please note that if you set up more than one App Account, each App Account may contain separate Related Device Settings Data.

  • (ⅱ) Information about your device on which the Application is installed (the “Installed Device”) and component parts thereof:

    Device ID which is to be allocated automatically, Android Advertising ID (if your Installed Device is an Android based device) and specifications/features (e.g. product type, manufacturer name, and model name);
    Operating System and Operating System version;
    Language code, country or region, time zone;
    Operational status of your Installed Device and component parts thereof (e.g. sensors and display); and IP address used by such Installed Device’s internet connection.

  • (ⅲ) Information about the Application:

    Application ID (assigned to the Application by us; it is not a unique identifier which would allow us to identify a specific user of a downloaded Application);
    Application version;
    Time stamp related to the usage of the Application on the Installed Device; and Information regarding the usage status and usage history of the Application on the Installed Device.

  • (ⅳ) Information about the device which is connected to the Installed Device and which is detected by or registered to the Application (namely, your E-USE headphones products, “Related Device”):

    Device ID (such as, Bluetooth address, serial number and the identifier which is to be automatically allocated at the time of registration) and specifications/features (e.g. product type, device name, manufacturer name, and model name);
    Operational status and setting information of the Related Device (e.g. software version; language; country or region);
    Information regarding the usage status and usage history of the Related Device (e.g. information regarding operations of the Related Device, functions in use, products/devices connected to the Related Device, errors); and Technical information regarding specifications of contents you listen to by the Related Device (e.g. codec). For the avoidance of doubt, this technical information does not allow us to draw conclusions on any contents you may have listened to.

  • (ⅴ) Information collected by surveys:

    From time to time, E-USE may ask you whether you would like to participate in one of our surveys. We may ask for information, such as your interests and preferences with regard to current and future audio-related products and services on the market.
    You can decide not to participate in the survey by closing the browser or tabs of the survey at any point during the survey.
    E-USE uses the above Collected Data for the purposes set forth in Section 3 below, as strictly required to fulfill these purposes in order to provide you with the features and functions of the Application.

3. How does E-USE use the Collected Data?

E-USE uses your Collected Data for the following purposes:

  • (i) Backup and restoration of settings function of the Application

    The Application provides a backup and restoration of settings service linked with your App Account, whereby the Related Device Settings Data are uploaded to and stored on our servers (“ Backup and restoration of settings”). This enables you to backup and restore your Related Device Settings Data when you change your Installed Device by installing the Application on a new device and signing in to the same App Account.

  • (ⅱ) Pushing updates to your Application or Related Device

    Each time you start the Application on your Installed Device, the Application sends a “request” to E-USE´s server to check whether any updates for the Application or the firmware of the Related Device are available and to send latest software or firmware in case any update should be available. For this, we only use your IP address.

  • (ⅲ) Providing “Help” upon your request

    If Help is requested by you, certain technical information about the Installed Device, about the Application and about the Related Device are transferred to E-USE in order to provide service to you through the Help feature. This transfer of data enables E-USE to provide you with “customized” Help webpages for the Application and the specific technical issue you experience.

  • (ⅳ) Improving/developing E-USE´s products and services

    E-USE uses the Collected Data to improve and develop E-USE’s current and future products and services, together with the data we collect through other E-USE audio applications if you use one of those. For the collected data through those applications, please refer to the privacy policies for those applications. Product improvement and/or development includes those relating to either an improvement of the technical functions of the Related Device or the usability of such product for user´s convenience. Such product improvement/development is only done with information that does not identify you personally, using aggregated and/or anonymized data.

    E-USE Affiliates may access and use the Collected Data together with the data we collect through other E-USE audio applications that you may use for internal business purposes to improve and develop E-USE’s current and future products and services as well, however only in an aggregated/anonymized, i.e. non-personal manner.

  • (ⅴ) Providing information and advertisements to you through Affiliates

    E-USE shares the Collected Data with its local operating E-USE Affiliate which may send you emails and provide you with information, recommendations and targeted and/or personalized advertisements regarding E-USE products, services and other offerings that may be of interest to you.     You can unsubscribe from receiving email marketing from E-USE Affiliates at any time using the “unsubscribe” link in such email or contacting us as described in the Contact Us section below.

    To the extent permitted by law, E-USE Affiliates may share de-identified Collected Data with network advertisers or others in order to target advertisements to you or limit the number of times you see advertisements. You may be able to opt out of certain targeted advertising by visiting TRUSTe’s website here. Please be aware that if you choose to block cookies, some advertising preferences dependent on cookies may not be able to be respected and that even if you opt out of targeted online advertising, you will continue to receive generic ads online.

4. Who else has access to the Collected Data?

We do not share personal information with third parties for their own marketing purposes but we may share non-personal information, including aggregate data and de-identified data, with third parties to the fullest extent allowed by law. In addition, E-USE may share Collected Data with E-USE Affiliates and third parties as follows:

E-USE Affiliates

Aggregated/anonymized or non-personal Collected Data may be shared with and used by other E-USE Affiliates for the purposes of product improvement/ and development as described above. E-USE may otherwise share Collected Data with E-USE Affiliates for other purposes set out in this Privacy Policy.

Service Providers

E-USE and E-USE Affiliates may use third party service providers to process the Collected Data on their behalf for the purposes set out in this Privacy Policy. Such third parties include, but are not limited to, IT service providers and data hosting providers.

Business transfer

In the event that E-USE or a E-USE Affiliate sells or transfers a portion or all of its business, the Collected Data may be transferred by E-USE or such E-USE Affiliate to the purchasing or acquiring entity as part of the transaction, including any due diligence process connected to the sale or transfer.

Government Authorities/ Law Enforcement Officials

Collected Data may be disclosed to government authorities and/or law enforcement officials if required by the applicable laws.

Other Unaffiliated Third Parties

We may disclose Collected Data to auditors or similar external consultants like lawyers or tax advisors, to defend and exercise our legal rights (e.g. enforcing compliance with the terms of use) and as we believe necessary to comply with our legal obligations.

5. Data Retention

E-USE will keep the Collected Data for as long as it is necessary for the relationship with you and the purposes detailed in Section 3 or otherwise permitted or required under applicable law.

E-USE may retain Collected Data for an appropriate period to protect ourselves from legal claims, to administer our business, or to the extent permitted by applicable law, which may require us to hold the relevant Collected Data for specific periods.

6. Transfer of the Collected Data internationally and Consent to processing

The Collected Data may be processed, stored and transferred to countries/regions outside your country/region of residence, including in particular Japan. By using the Application, or providing us with any information, you fully understand and consent to this transfer, processing and storage of your information in the United States, Japan and other jurisdictions, where the privacy laws may not be as comprehensive as those in the country where you reside and/or are a citizen.

7. Security

E-USE undertakes reasonable security measures designed to protect against the loss, misuse or alteration of the Collected Data. Although E-USE strives to protect the Collected Data, E-USE cannot guarantee or warrant the security of any Collected Data transmitted to E-USE through the Application or that E-USE stores on its systems or that is stored on E-USE’s third party contractors’ systems.

8. Policy Regarding Children

E-USE is committed to complying with all applicable laws and regulations regarding the collection, storage and use of the Collected Data concerning children, including the Children’s Online Privacy Protection Act in the United States. This Application is intended for a general audience; the Application is not directed to and does not knowingly collect personal information from children younger than age of 16. If you are a parent or guardian and are concerned that your child has provided E-USE with personal information (as defined by applicable law), you should contact us as indicated below.

9. Changes/Policy Governs Use

E-USE reserves the right to make changes to this Privacy Policy and will notify you of any changes by prominently posting notice of the amendment on or within the Application. We may also provide notice to you in other ways, such as through contact information you have provided. You are advised to consult the posted Privacy Policy regularly for any changes.

If you are a California resident, under the California “Shine the Light” law, you have the right to receive: a) information identifying any third party company(ies) to which we may have disclosed, within the past year, personal information pertaining to you and your family for that company’s direct marketing purposes; and b) a description of the categories of personal information disclosed. To obtain such information, please email your request to, and include your name, email address, and a reference to “Your California Privacy Rights – App.” We are not responsible for requests that are not labeled or sent properly, or do not have complete information.

Notice to Nevada Residents:

If you are a Nevada resident, you have the right to opt-out of the sale of certain personally identifiable information we have collected about you to third parties. E-USE does not currently sell your personally identifiable information as those terms are defined under Nevada law. However, if you wish to submit a request to opt-out of the sale of such information if E-USE were to engage in such a sale in the future, you may submit your request in writing to: Your request must reference “Your Nevada Rights – App” and include your name, mailing address, zip code, and email address. We are not responsible for requests that do not come through the designated request mechanism or do not contain sufficient information to allow us to process your request. We will respond to valid requests within 60 days.
